Why Bars, Apartments, and Schools Top the List for Texas Gun Violence

Texas law firm Hampton & King analyzed firearm incidents across Texas over a five-year period. Crucially, researchers specifically focused on premises liability and negligent security. This means they left out private home invasions and focused strictly on public and commercial places where property owners and managers have a legal duty to keep visitors safe.

They found that an overwhelming 81% of all these incidents happened in bars and nightclubs, apartment complexes, and schools. Here is a look at why these locations are so vulnerable.

1. Bars and Nightclubs

  • The Situation: Nightlife venues are the number one most common location for these incidents. Even worse, they are incredibly dangerous when a conflict occurs: an overwhelming 93% of the reported incidents resulted in physical harm or death.
  • Why Security Fails: Nightlife environments are volatile by nature, blending alcohol, packed crowds, late hours, and high emotions. Under Texas Penal Code §46.03, it is strictly illegal to carry a firearm into a business that makes most of its money from alcohol sales. When an incident happens anyway, it usually points to a breakdown in perimeter security. Failing to use metal detectors, skipping ID checks, or lacking trained security personnel leaves patrons vulnerable to foreseeable harm.

2. Apartment Complexes

  • The Situation: Multi-family housing and apartment complexes ranked as the second highest location on the list. However, they proved to be the most lethal of the top three, with more than half of the incidents resulting in a fatality.
  • Why Security Fails: Unlike a restaurant or a retail shop, an apartment complex is where people live, making them common areas for domestic disputes or targeted property crimes. Because these properties cover massive physical areas, including large parking lots, dark stairwells, and courtyard walkways, they require active upkeep. When landlords ignore broken security gates, leave common areas completely unlit, or neglect perimeter fencing, they create unmonitored spaces that invite violent crime.

3. Schools and Campuses

  • The Situation: Educational institutions ranked third on the list. However, the nature of these school numbers is widely misunderstood, as only 12% of school-based incidents resulted in physical injuries or casualties.
  • Why Security Fails: This high spot on the list doesn’t mean Texas is experiencing hundreds of active shootings. Because the study focuses on premises safety, this number heavily reflects proactive weapon possession reports, meaning students or visitors were caught bringing a gun onto campus. Schools rank high because they are tightly regulated, heavily monitored environments. Active security measures, anonymous tip lines, and school resource officers mean firearms are being intercepted before harm occurs, showing exactly why strict preventative security works.

Importance of Security 

Landlords, business owners, and school administrators all have a legal responsibility to maintain a safe environment. From a legal standpoint, property liability isn’t about blaming a business owner for the random actions of a criminal. Instead, it’s about accountability: if a property has a known history of security issues and management does nothing to upgrade its security, it is negligence.
